Recording special education meetings (Virginia)
In Virginia, special education rules say the school division must allow parents to audio record certain formal meetings: meetings about eligibility, meetings to develop, review or revise the IEP, and certain discipline reviews. This rule covers those meetings only.
The parent tells the school in writing before the meeting and brings their own equipment. If you can't write in English, the written notice isn't required. If you don't tell the school ahead of time, the rule says you give the school a copy of the recording. The recording becomes part of the child's education record. Local policy can limit video recording, and recording at other meetings. The special education rule does not cover ordinary phone calls with a teacher. For calls, a written call log and a follow-up email can help, and a legal aid organization can answer questions about recording.
